Scope of application

These General Terms and Conditions (GTC) apply to all business relationships between QUTTING EDGE SWISS GMBH and its customers in the version current at the time of conclusion of the contract, unless a separate written agreement has been concluded between QUTTING EDGE SWISS GMBH and the customer or a written framework agreement has been concluded. The GTC apply exclusively. Any terms and conditions of the customer or contractual partner that conflict with or deviate from these GTC shall not be accepted, unless QUTTING EDGE SWISS GMBH has expressly recognized them in writing in individual cases. Should individual provisions of these GTC be or become initially invalid, this shall not affect the validity of the remaining provisions of the GTC.

Delivery times

The delivery periods stated by QUTTING EDGE SWISS GMBH are not binding – unless otherwise agreed in writing – but will be adhered to wherever possible. QUTTING EDGE SWISS GMBH is entitled to make partial deliveries, but the customer will not incur any additional costs as a result. In the event of delays for which QUTTING EDGE SWISS GMBH is not responsible, the customer shall not be entitled to withdraw from the contract and/or claim damages.

Transportation / Delivery

Ex warehouse, or FCA Sursee-LU (FCA according to Incoterms 2020).

Binding nature of offers

The offers of QUTTING EDGE SWISS GMBH are valid for a period of 30 days from the date of the offer.

Price changes

If there are at least three months between the conclusion of the contract and the delivery, we expressly reserve the right to make price changes due to changes in raw material prices, taxes, duties, fees and taxes of all kinds that have occurred in the meantime, as well as due to currency fluctuations.

Terms of payment

Online orders via the webshop are payable immediately during the ordering process using secure payment methods available in the webshop. For retail customers, QUTTING EDGE SWISS GMBH invoices are payable net (without deductions) within 14 days of the invoice date, unless otherwise agreed. Upon expiry of this payment period, the consequences of default shall take effect immediately, even without a reminder. Reminders from QUTTING EDGE SWISS GMBH will be charged at a flat rate of CHF 50.00 each.

Warranty / Liability

QUTTING EDGE SWISS GMBH grants a warranty on new goods ex works within the framework of the conditions specified by the original manufacturer. The customer is entitled to the delivery of defect-free goods. The customer is obliged to inspect the goods purchased from QUTTING EDGE SWISS GMBH for any defects immediately upon receipt. Any notification of defects must be made immediately and in writing, otherwise the goods shall be deemed accepted and approved.

Color & color fastness / aging process

The colors of QUTTING EDGE SWISS GMBH products may change or fade slightly over time due to sunlight and/or other climatic or environmental influences. Such changes as well as the natural abrasion of the polymer and the other natural aging behavior do not constitute a defect.

Retention of title / consignment

The goods delivered by QUTTING EDGE SWISS GMBH shall remain the sole property of QUTTING EDGE SWISS GMBH until full payment of all claims against the customer, including future claims.

Extraordinary events

In the event of force majeure (e.g. acts of war, natural disasters, natural disasters, epidemics and pandemics) and other unforeseeable events, QUTTING EDGE SWISS GMBH shall be entitled to withdraw from the contractual obligations or from the contract in whole or in part without the customer being entitled to subsequent delivery and/or compensation.

Data

QUTTING EDGE SWISS GMBH processes, uses and stores customer data if and insofar as this is necessary for the fulfillment of the contract. Further information on data protection can be found on the QUTTING EDGE SWISS GMBH website under the heading “Legal”.

General Terms and Conditions for the NomadFace® Affiliate Program

Welcome to the affiliate program of NomadFace®. By registering and participating in the program, you accept the following terms and conditions:

  1. Commissions

    Affiliates receive a commission of 15 % on every confirmed sale generated through their personal affiliate link.

  2. Duration of the tracking cookie

    The affiliate link is for 60 days valid. Purchases made within this period will be credited to the corresponding affiliate.

  3. Payment of commissions

    Payments are made after a minimum amount of [e.g.B. 20 CHF] and after a waiting period of 14 daysto rule out returns or refunds.

  4. Invalid commissions

    No commission is paid if an order is returned or canceled. No commission is paid for purchases made by the affiliate themselves.

  5. Permitted advertising

    Affiliates agree to promote NomadFace® ethically and honestly. Spam, misleading advertising or direct competition with official NomadFace® campaigns are not permitted.

  6. Changes to the conditions

    NomadFace® reserves the right to change these terms and conditions at any time. Affiliates will be notified in advance of any material changes.

Applicable law / place of performance / place of jurisdiction

Swiss law applies. The place of performance and jurisdiction is Sursee (Canton of Lucerne, Switzerland).
